My buyer is currently under contract and out of the option period.... he just received notice yesterday that he is being promoted and relocated out of Texas, can he get his earnest money back?

if its being financed and your contingency on financing is still in place, There is a possibility that lender wont approve him. if lender send you a letter of Denial because he is no longer able to live there as homestead, then he might.
